Privacy Policy at LoanMe Sp. z o. o.

In this document, we inform all our Users about whether, how and what their personal data will be collected and used by LoanMe Sp. z o.o. (LoanMe). The Privacy Policy contains information on:

  • what Users' data can be collected in the recruitment process, granting loans, using the website and as part of cooperation with contractors, and how these data are processed and secured;
  • how Users' data may be used by LoanMe, including on what terms they may be disclosed to third parties;
  • how to change the User's personal data;
  • cookies policy;
  • processing of data of minors.

The administrator of your personal data is LoanMe with its registered office in Warsaw, Aleje Jerozolimskie 142B street, entered in the Register of Entrepreneurs kept by the DISTRICT COURT FOR WARSAW IN WARSAW, XII ECONOMIC DEPARTMENT OF THE NATIONAL COURT REGISTER, under KRS number 0000544100, with tax identification number NIP 5272729611 and REGON 360839407.

LoanMe does not transfer personal data to countries outside the European Union. We will transfer your personal data to our suppliers to whom we will order services related to the processing of personal data, such as: a company providing hosting services, a company providing maintenance and development services of the Website; entities authorized to obtain data on the basis of applicable law, e.g. courts or law enforcement authorities - of course, only if they make a request based on an appropriate legal basis. Access to personal data to unauthorized entities according to this Privacy Policy may only take place with the prior consent of the data subject.

Each entity entrusted with processing your personal data by LoanMe based on a contract for entrusting the processing of personal data (hereinafter referred to as the entrustment contract) guarantees an appropriate level of security and confidentiality of personal data processing.

You have the right to lodge a complaint with the supervisory authority, i.e. the President of the Office for Data Protection, Stawki 2 street, 00-193 Warsaw and the following rights related to the processing of personal data:

  • the right to access data – i.e. the right to ask LoanMe if we process your personal data, as well as request information, including on the purposes of data processing. To access the information stored by LoanMe, contact us by post, e-mail or telephone;
  • the right to request correction, limitation or deletion of data – if you have provided us with personal data, you can update it. In order to provide instructions on updating data, limiting their processing or deleting them, contact us by post, e-mail or phone;
  • the right to object – you have the right to object to LoanMe to the extent that the basis for the processing of personal data is the premise of the legitimate interest of LoanMe, including profiling (e.g. sending personalized offers). You also have the right to object to any results of data processing that violate his rights and which are carried out solely through automated systems. To raise an objection, please contact us by post, e-mail or phone;
  • the right to withdraw consent – to the extent that the basis for the processing of personal data is your consent, you have the right to withdraw it at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. To withdraw your consent, contact us by post, e-mail or phone;
  • the right to transfer data – to the extent that your data is processed for the conclusion and performance of the contract or processed on the basis of your consent, you have the right to transfer personal data, i.e. to receive personal data from LoanMe, in a structured, commonly used format machine-readable. At your request, this data may be sent to another data administrator. The right to transfer data does not apply to data that is a business secret. In order to exercise your right to data portability, please contact us by post, e-mail or telephone;

Communication between your device and the Website is encrypted using the SSL protocol. LoanMe also indicates that the use of the Internet and services provided electronically, especially the use of publicly available Wi-Fi networks, may be associated with specific ICT threats, such as the presence and operation of worms, spyware or malware , including computer viruses, as well as the possibility of being exposed to cracing or phishing (catching passwords), and more. To obtain detailed and professional information on maintaining security on the Internet, LoanMe recommends that they be obtained from entities specializing in this type of IT services.

LoanMe uses technical and organizational measures to ensure the protection of personal data being processed appropriate to the threats and categories of data being protected. All necessary technical measures specified in art. 25, 30, 32-34, 35-39 GDPR ensuring increased protection and security of processing Users' personal data.

COOKIES

In order for the Website to function properly, LoanMe uses Cookies technology. Cookies are packets of information saved on your device via the Website, usually containing information consistent with the purpose of the file, with which you use the Website - these are usually: website address, date of placing, expiry date, unique number and additional information in accordance with the purpose of the file.

The website uses two types of Cookies: (a) session cookies, which are permanently deleted when your browser session ends; (b) persistent, which remain after the end of the browser session on your device until they are deleted.

Based on cookies, both session and permanent, it is not possible to determine your identity. The Cookies mechanism does not allow the collection of any personal data.

Website cookies are safe for your device, in particular they do not allow viruses or other software to enter your device.

Files generated directly by the Website cannot be read by other websites. External Cookies (i.e. Cookies placed by entities cooperating with LoanMe) can be read by an external server.

You can change the cookie settings yourself at any time, specifying the storage conditions, through your web browser settings or by configuring the service. You can also delete Cookies stored on his device at any time, according to the instructions of the browser manufacturer.

You can disable saving Cookies on your device in accordance with the browser manufacturer's instructions, but this may result in the unavailability of some or all of the Website's functions.

LoanMe uses its own Cookies for the following purposes: authenticating the User on the Website and maintaining the User's session; configure the Website and adapt the content of the pages to the User's preferences or behavior; analysis and audience survey, the number of clicks and paths to navigate the site to improve the appearance and organization of content on the site, time spent on the site, the number and frequency of visitors to the Website.

For job candidates

The scope of personal data processed determines the scope of the data supplemented by you and then sent to LoanMe using the appropriate data form and in the CV file.

We will process your personal data to:

  • assess your qualifications for the position you apply for;
  • assess your abilities and skills needed to work in the position for which you apply;
  • choose the right person for the job.

The legal basis for processing your personal data is:

  • The provision of law (Article 221 § 1 of the Labor Code) and the processing needed to conclude an employment contract, mandate contract, work contract, a contract regulated by the Labor Code or a B2B contract - regarding the following data: name and surname; parents' names; Date of birth; place of residence (mailing address); education; current employment history.
  • Your consent to the processing of data provided in the form, CV and cover letter, if you provide us with data other than: name and surname; parents' names; Date of birth; place of residence (mailing address); education; current employment history.
  • Our legitimate interest - in the scope of data collected during the interview and the results of qualification tests. We have a legitimate interest in checking your skills and abilities - we need it to assess whether you are the right person for the position for which we are recruiting.

As part of recruitment, we may collect your publicly available data from LinkedIn. These are information published on this site by you regarding your professional experience, positions held, education, publications and knowledge of foreign languages.

The website may store http queries in connection with which, in the server log files some information may be saved, including the IP address from which the query came, the name of the User's station

- identification carried out by the http protocol, if possible, system date and time of registration and receipt of the query, information about errors that occurred during the implementation of the http transaction. Logs can be collected as material for proper administration of the Application. Only persons authorized to administer the IT system have access to information. Files with logs can be analyzed in order to compile Website traffic statistics and errors. Summary of such information does not identify the User.

We will store your personal data until the recruitment process is completed. Then, if we have not signed a contract with you - the documents will be destroyed up to 3 months. Unless you agree to participate in further recruitments - then we will keep your documents for the next 12 months.

For future and current borrowers

At the stage of telephone contact with LoanMe Agent, you can voluntarily provide your personal data in order to join the Loan Agreement. Such personal data is processed by LoanMe on the basis of directly granted consents, in accordance with their content and applicable law.

If you are interested in receiving a loan, you can voluntarily undergo creditworthiness verification and for this purpose log in to the Instantor service via LoanMe websites once, through which LoanMe collects confirmation of your bank account and inflows (verification). In some cases, we will process data for special categories (e.g. health data). The transfer of some personal data may be necessary to conclude a contract and provide services. If you do not agree to provide this data, you will not be able to conclude a contract.

The data you enter in the online form are protected by encryption using the SSL (Secure Socket Layer) protocol.

We process your personal data in order to:

  • Undertaking activities aimed at concluding the loan agreement, its implementation and handling of possible complaints,
  • the implementation of services provided electronically - the basis for processing is the necessity of processing to perform this service (Article 6 (1b) of the GDPR),
  • ensuring greater security of services, including to detect fraud and abuse - the basis for processing is our legitimate interest (Article 6 (1f) of the GDPR).
  • taking measurements that allow us to improve services - the basis for processing is our legitimate interest (Article 6 (1f) of the GDPR),
  • sending commercial information (with additional consent).
  • Due to the necessity resulting from the provisions of law regarding the assessment of Users' credit risk, the User who completes the loan application is asked to consent to the verification of his creditworthiness at the economic information offices (Article 6 (1c) of the GDPR),

In the event that you give your consent, telephone numbers may be contacted to the phone number provided to submit your offer, as part of direct marketing activities undertaken by LoanMe, also using automated calling systems and telecommunications terminal equipment.

LoanMe makes decisions in an automated manner in terms of assessing creditworthiness and preventing fraud. This analysis is part of the verification of the loan application and has an impact on the LoanMe credit decision.

Your personal data is processed by LoanMe for the period required by law, the duration of the Loan Agreement or for the period in which the User consents to the sending of commercial information.

LoanMe uses appropriate technical and organizational measures necessary to ensure confidentiality, integrity, accountability and adequacy of data, as well as to secure data against unauthorized use or processing. LoanMe also uses organizational and technical measures to prevent the unauthorized person from obtaining and modifying personal data provided by the User on the Website, and above all an encrypted SSL connection.

For website users who are not LoanMe customers

You decide whether to share LoanMe data. By visiting our websites you can leave your phone number and / or email address to arrange contact from LoanMe.

You only provide a phone number or possibly an email address that will allow you to take further action to grant you a loan. At this stage, we do not process any other personal data that allows identification.

For trading partners

Your personal data will be processed for several different purposes, i.e. for the proper performance of the contract, to perform legal obligations, including tax obligations, and may also be processed for pursuing claims under civil law and defending against such claims, if they arise.

The legal basis for processing your personal data is:

  • Art. 6 clause 1 lit. b GDPR, i.e. processing is necessary for the implementation of the civil law contract that connects us,
  • Art. 6 clause 1 lit. c GDPR, i.e. processing is necessary to fulfill our obligations such as conducting financial settlements, including tax settlements and the obligation to record the number of hours worked.
  • Art. 6 clause 1 lit. f GDPR, i.e. processing is indispensable for the implementation of the objectives arising from our legitimate interests, such as the possible need to resist or implement civil law claims.

If, as a result of cooperation, we are forced to process your sensitive data, such as data on your health, the basis for their processing will be art. 9 item 2 lit. b, i.e. processing may be necessary to perform our obligations and rights arising from labor law, such as e.g. sick leave documentation. At the same time, we ensure that we do not process any personal data, in particular sensitive data, if we are not obliged to do so.

Your personal data will be stored for the period necessary for specific data processing. Certainly, the data will be processed for the duration of the contract connecting us, as well as for the duration of any claims related to it, i.e. for at least 10 years from the termination of the contract - in accordance with the general limitation period pursuant to art. 118 of the Act of 23 April 1964 Civil Code (Journal of Laws 2017.459 i.e. of 2017.03.01).

The current regulations require us to keep payrolls, payroll cards or other evidence for 50 years on the basis of which the basis for calculating retirement or disability pensions is determined (Article 125a (4) of the Act of 17.12.1998 on pensions from the Social Insurance Fund) . In this regard, personal data will be processed by us during the period indicated above.

Your personal data will be processed in a partially automated way, because we will process it to some extent on computer resources. However, as part of data processing, we do not use methods based on automated decision making, including profiling.

Providing your data is voluntary, but it is necessary for the implementation of the contract between us.

Data of minors

Only adults who have full legal capacity may use this website. Use of the site by minors is prohibited and pointless from the point of view of the type of services provided by LoanMe, presented on these websites. No personal data of minors is collected or processed by LoanMe.
